Note: The English version of the GTC is for better understanding only. The German version alone is legally valid.

These General Terms and Conditions (GTC) apply to all paid services offered by BV Frankfurt 06 e.V. (hereinafter referred to as the club), in particular sports courses for adults.

Registration and conclusion of contract

Registration for sports courses is only possible via the registration form on the club’s website (bvfrankfurt.de). Registration does not guarantee participation in a course. The contract is concluded when the club confirms participation by email.

If courses are fully booked, the club will maintain a waiting list and contact the registrant if a place becomes available.

The contract is valid for the duration of the booked course and ends automatically at the end of the course without the need for termination. Participation in a sports course does not constitute club membership.

Terms of payment and contract termination/cancellation

Course fees can only be paid by SEPA direct debit. The fee is due upon confirmation of registration. Any return debit fees charged to the club must be paid by the course participant. Cancellation of a booked course can only be made via the club’s website. The cancellation conditions are announced on the website for the respective event. Course fees to be refunded by the club will be transferred to the bank account used for payment.

If the participant discontinues the course or does not show up, there is no entitlement to a refund of the fee.

Course cancellation by the club

In the event of course cancellation (minimum number of participants not reached, lack of coaches, closure of the sports hall, official or legal prohibitions, or other unforeseeable events), a new date will be agreed upon or the course fee will be refunded on a pro rata basis. Any further claims against the club, in particular claims for damages, are excluded.

Participant obligations

Participants agree to follow the instructions of coaches and other authorized persons. During the sports course, participants must adhere to the respective house rules of the sports hall. Only indoor sports shoes that have not been worn outdoors may be worn in the sports hall.

If the participant does not comply with the requirements, the club reserves the right to exclude them. In this case, there is no entitlement to a refund of course fees.

Health

The club accepts no liability for health risks to participants in connection with their participation in sports courses. It is the participant’s responsibility to check their state of health beforehand.

Liability & insurance cover

The club is not liable for damage or loss suffered by participants while practicing sports or using the club’s facilities, equipment, or devices, unless such damage or loss is covered by insurance. The club is not liable for clothing, valuables, or cash brought to the sports course. Participants are liable for any negligent or intentional damage to the club’s property.

Data protection

The personal data provided by the participant during registration will be stored and processed for the purposes of conducting and handling the sports courses. This applies in particular to the data necessary for invoicing and payment processing. By registering, the participant consents to the storage of data for this purpose.

Rechtsgrundlage ist Art. 6 Abs. 1 S. 1 lit. f) DS-GVO.

The information to be provided in accordance with Art. 13 and 14 GDPR regarding the rights of data subjects in relation to the aforementioned data processing can be found in the club’s privacy policy.

Photos during sports courses

Fotos über die Sportkurse werden zum Zweck der Außendarstellung auf der Webseite sowie den Social-Media-Kanälen des Vereins veröffentlicht. Für die Veröffentlichung von Fotos von Erwachsenen auf der Webseite ist die Rechtsgrundlage das nachfolgend beschriebene berechtigte Interesse des Vereins nach Artikel 6 Absatz 1 Satz 1 f) DSGVO: Fotos mit Bezug zum Sportkurs bzw. der Veranstaltung aufgrund des berechtigten Interesses, über das (sportliche) Geschehen zu berichten.

Participants have the option to object to the use of such photos in which they appear in accordance with Article 21(1) GDPR. The club will check whether there are compelling legitimate grounds for the processing that outweigh the interests, rights, and freedoms of the participant. If not, the photo in question will be deleted.

Severability clause

Should any provision of the contract or these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. Invalid or missing provisions shall be replaced by provisions that come closest to the legal and economic intent of the parties as expressed in this contract.
